The most important documents in your estate plan are the Powers of Attorney. The Durable Power of Attorney allows you to select the loved ones you want to make legal, business, financial, and decisions about where you will live. The power of attorney ceases at death. Powers of Attorney will usually eliminate the need to get court involvement to name a Conservator or Guardian.
The Durable Power of Attorney needs to be very detailed and comprehensive. Since 2013, it needs to be signed by the agents named in the document in addition to the maker of the document. It should be notarized in the event it is ever used to sign a deed and needs to be recorded.
